DUI Defenses That Work

There are a variety of DUI defenses that can reduce the power of the prosecutions case, which is strong to begin with only because they are in Utah, and the bulk of the juries are Mormon. Don't forget, as good as your case may be, you are selling it to at least a 30% Mormon jury and the entire jury must be unanimous either for or against before you can be convicted OR found not guilty.

That's why the best defenses are often performed by analyzing the scene and seeing whether the fourth amendment has been violated by the police which happens often. If you were stopped illegally, for a non-reason, or a bogus one, the evidence in your case MUST be suppressed and the state can't use any of it. However, too many people forget that this right must be enforced after it is requested. If you don't ask, you could have a cop state "I pulled him over because he looked like a jerk," and even though the judge knows about it, if you don't properly request that the arrest be suppressed, in legal language, the court will not do it on its own.
